I. Basic Provisions

4. The controller has not appointed a data protection officer.

II. Sources and Categories of Processed Personal Data

1. The controller processes personal data provided by you or personal data obtained based on the execution of your order.

2. The controller processes your identification and contact details for the purpose of contract fulfillment (customer order) and marketing data.

III. Legal Basis and Purpose of Personal Data Processing

1. The legal basis for processing personal data is:
• Fulfillment of the contract between you and the controller according to Article 6(1)(b) GDPR,
• 
The controller’s legitimate interest in direct marketing (especially for sending commercial communications and newsletters) according to Article 6(1)(f) GDPR,
• Your consent to processing for direct marketing purposes (especially for sending commercial communications and newsletters) according to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on Certain Information Society Services, if no order for goods or services has been placed.

2. The purpose of personal data processing is:
• 
To process your order and exercise rights and obligations arising from the contractual relationship between you and the controller; when placing an order, personal data necessary for the successful processing of the order (name, address, contact) is required; providing personal data is a necessary requirement for concluding and fulfilling the contract, without which it is not possible to conclude or fulfill the contract,
• Sending commercial communications and conducting other marketing activities.

3. The controller does not engage in automated individual decision-making within the meaning of Article 22 GDPR. You have given your explicit consent to such processing.

IV. Data Retention Period

1. The controller retains personal data:
• For the period necessary to exercise rights and obligations arising from the contractual relationship between you and the controller and to assert claims from these contractual relationships (for 15 years from the termination of the contractual relationship), 
• Until consent for processing for marketing purposes is revoked, but no longer than 60 years if the personal data is processed based on consent.

2. After the retention period expires, the controller deletes the personal data.

V. Recipients of Personal Data (Controller’s Subcontractors)

1. Recipients of personal data include:
• Persons involved in the delivery of goods/payment processing based on a contract,
• Providers of e-shop operation services (Shoptet) and other services related to e-shop operation,
• 
Providers of marketing services:

2. The controller does not intend to transfer personal data to a third country (outside the EU) or an international organization. Recipients of personal data in third countries include providers of mailing/cloud services.

VI. Your Rights

1. Under the GDPR, you have:
• The right to access your personal data under Article 15 GDPR,
• 
The right to rectification of personal data under Article 16 GDPR, or restriction of processing under Article 18 GDPR.
• The right to erasure of personal data under Article 17 GDPR.
• The right to object to processing under Article 21 GDPR,
• 
The right to data portability under Article 20 GDPR. 
• The right to withdraw consent for processing in writing or electronically to the controller’s address or email specified in Article III.

2. You also have the right to file a complaint with the Office for Personal Data Protection if you believe your right to personal data protection has been violated.

VII. Personal Data Security Measures

1. The controller declares that appropriate technical and organizational measures have been taken to secure personal data.

2. The controller has implemented technical measures to secure data storage and personal data records, particularly through passwords, antivirus programs, encryption, and backups.  

3. The controller declares that personal data is accessible only to authorized persons.

VIII. Final Provisions

1. By submitting an order via the online order form, you confirm that you have read this Privacy Policy and fully accept it.
